Marine Insurance FAQ

Does the seller's or buyer's insurance cover my cargo?

It depends on the Incoterms agreed in your trade contract. Under CIF terms, the seller provides insurance. Under FOB or EXW terms, the buyer is responsible from the point of loading. Many businesses incorrectly assume the freight forwarder or carrier's liability covers their cargo value — it typically does not. We help clients understand their exposure under each Incoterm and ensure they are not unknowingly uninsured.

What is the difference between ICC A, B, and C clauses?

ICC (A) is all-risks cover — it covers all losses unless specifically excluded. ICC (B) and (C) are named-perils policies covering a narrower set of causes of loss. For most commercial cargoes, we recommend ICC (A) as the additional premium over (C) is typically small relative to the protection gained.

What happens if my cargo is damaged and the ship is not at fault?

If you suffer a loss and the carrier is not liable (e.g., weather damage), your cargo insurance covers the loss. If the carrier is negligent, your insurer will pay and then seek recovery from the carrier on your behalf — known as subrogation. In either case, you are protected.
